No, herpes is a localised infection. It just means they have oral (mouth) herpes, which is usually caught as a child from an affectionate kiss form a family member or another child.
Oral herpes (cold sores) are usually caused by the virus hsv-1.
However, genital herpes can also be caused by hsv-1 - it is as likely to be cuased by hsv-1 as by hsv-2 - so if you allow someone with oral herpes to give you oral sex, and you don't have a history of cold sores yourself, you are putting yourself at the same risk of catching genital herpes as you would be by having unprotected intercourse with a partner who has genital herpes.

now...with that said...
if you perform oral sex on your partner that person IS at risk for contracting genital herpes, especially if you are having an outbreak. and if you kiss your partner on the mouth during a cold sore outbreak and then your partner performs oral sex on you...that is how YOU can get it.
also...if you have an active cold sore on your face and touch it and then touch yourself on your genitals, you can actually give genital herpes to yourself.
